These conditions and disclaimer apply to all participants of guided bike tours and rental services operated by Dominik Vaverka trading as pedalczech.cz.

1. Inherent risks of cycling
Cycling is a sporting activity with inherent risks, including but not limited to:
- Falls and collisions
- Uneven terrain and road surfaces
- Traffic and other road users
- Weather conditions such as wind, rain, heat, or slippery surfaces
- Physical fatigue or dehydration
- Equipment failure despite regular maintenance
By booking and participating in a guided tour or by renting a bicycle, you acknowledge these risks and agree to participate at your own responsibility, to the fullest extent permitted by applicable law.
2. Participant requirements
To participate in a guided tour or rental, you must:
- Be at least 18 years old, unless participating as a minor accompanied by a parent or legal guardian who assumes full responsibility
- Be medically fit for a cycling activity of the selected difficulty and duration
- Be able to ride a bicycle confidently and safely
- Not be under the influence of alcohol, drugs, or medication that may impair your ability to ride safely
- Be able to present a valid ID document at check-in or handover for visual verification only
- Be responsible for arranging your own travel or accident insurance where appropriate
If any of these conditions are not met, the Provider reserves the right to refuse participation or handover of the bicycle on safety grounds.
3. Safety rules
The following rules are mandatory throughout the tour or rental period:
- A helmet provided by the Provider must be worn at all times while riding
- Participants must follow the guide’s instructions without delay
- All participants must comply with applicable traffic laws and regulations
- Participants may not separate from the group during a guided tour without the guide’s express consent
- Any health issue, discomfort, accident, or mechanical problem must be reported immediately
- Mobile phone use while riding is prohibited unless the rider has stopped in a safe place
Failure to comply with these safety rules may result in exclusion from the tour or termination of the rental for safety reasons.
4. Liability
4.1 Provider’s liability
The Provider is liable only for damage caused to the participant by a proven breach of legal duty on the part of the Provider or guide. The Provider is not liable for:
- Damage caused by the participant’s own negligence or misconduct
- Failure to follow instructions or safety rules
- Ordinary risks inherent in cycling and outdoor activity
- Acts of third parties or circumstances beyond reasonable control
Nothing in these conditions excludes or limits liability where such exclusion is not permitted under applicable law. Under Czech law, liability for intentional harm or harm caused by gross negligence cannot be excluded in advance.
4.2 Participant’s liability
Participants are responsible for any damage caused to the bicycle, e-bike, accessories, or other equipment during the period in which the equipment is in their possession or use, except for ordinary wear and tear.
- Guided tours: In the event of intentional damage, grossly negligent conduct, or serious breach of the guide’s instructions resulting in damage to the bicycle or equipment, the participant is liable for the actual damage caused, up to the bicycle’s current fair value.
- Rentals: The participant is liable for damage, loss, theft, destruction, or non-return of the bicycle and accessories, up to the bicycle’s current fair value at the time of the incident.
The bicycle’s current fair value will be determined with regard to its type, age, condition, and normal depreciation. If repair is possible, the participant is liable for the actual and reasonably incurred repair costs.
4.3 Insurance
The Provider maintains liability insurance for business activities where applicable. Participants are strongly advised to arrange their own travel, accident, or liability insurance, especially if visiting from abroad or engaging in sporting activities not covered by standard policies.
5. Cancellation and weather policy
Guided tours
Guided tours are payable at the meeting point by card or cash, unless agreed otherwise in advance.
If a participant needs to cancel, they should inform the Provider as soon as possible by phone or email. No cancellation fee is charged for late cancellation or no-show; however, the Provider reserves the right to refuse future bookings from participants or groups with repeated no-shows.
The Provider may cancel, shorten, postpone, or modify a tour due to adverse weather, safety concerns, technical issues, or other operational reasons. In such cases, if no payment has yet been made, no payment is due. If any payment was made in advance exceptionally, a rescheduled date or appropriate refund will be offered.
Bicycle rentals
Rental fees are payable upon handover of the bicycle to the customer, by card or cash, unless agreed otherwise in advance.
A refundable cash deposit may be required at handover. The amount of the deposit depends on the type of bicycle and will be communicated before confirmation of the booking.
If the customer cancels the rental, they should notify the Provider as early as possible. No cancellation fee is charged for late cancellation or no-show, but the Provider may refuse future bookings from repeat no-show customers.
6. Photography
Photos or videos may occasionally be taken during tours for the Provider’s website or social media. Participants who do not wish to appear in photographs or videos should notify the guide before the tour begins.
7. Governing law
These conditions are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code.
If these conditions are made available in more than one language, the Czech version shall prevail in the event of any discrepancy.
